Pilot Receivables Management, is a foreign limited liability company registered in the State of Ohio. Its registered agent for service of process is Unifund Corporation, 10625 Techwoods Circle, Cincinnati, Ohio 45242.
Pilot Receivables Management purchases defaulted upon consumer credit card debts and files suit through Unifund CCR Partners upon said debts in various Florida County Courts to collect said debts. PRM transmits the information regarding the aforesaid debts by transmitting information to Unifund CCR Partners’ debt collector attorneys located in Florida as well as third party collection agencies located in Florida and other states.
In a lawsuit filed by Consumer, Tichelle King Weeks, it was alleged that Pilot Receivables Management sought to collect an alleged debt from Ms. Weekes arising from her use of a “CITI AADAVANTAGE WORLD MASTERCARD” brand credit card used by Ms. Weekes for personal, family or household purposes. It was further alleged that due to typesetting limitations a AA has been inserted in the second word of the credit card name in place of the American Airlines logo, which consists of double capital A’s with the likeness of an eagle in between.
The basis for the lawsuit is that Unifund CCR Partners, filed suit against Ms. Weekes, in an attempt to collect on an alleged debt owned by PRM, even though Pilot Receivables Management, LLC could not legally take such action because it was not licensed by the State of Florida as a “Consumer Collection Agency.”
Florida law specifically and unequivocally states: [a]after January 1, 1994, no person shall engage in business in this state as a consumer collection agency or continue to do business in this state as a consumer collection agency without first registering in accordance with this part, and thereafter maintaining a valid registration. Fla. Stat. § 559.553(1).
The FCCPA defines “consumer collection agency” as “any debt collector or business entity engaged in the business of soliciting consumer debts for collection or of collecting consumer debts, which debt collector or business is not expressly exempted as set forth in s. 559.553(4).” Fla. Stat. 559.55(7).
