Stop The Harassment!
In May of 2014, Consumer Joseph Vanover filed suit against PFS alleging that on March, 13, 2014, he was contacted at work regarding an alleged outstanding debt. Consumer further alleged that a representative of PFS told him that his wages would be garnished on his next paycheck if he did not make a payment that day. In the lawsuit, Consumer further alleged that PFS refused to provide him anything in writing regarding the alleged debt and that it did not notify him of his right to dispute the alleged debt. Consumer agreed to set up a payment plan but PFS refused.
Consumer’s lawsuit further alleged that PFS’s conduct violated the FDCPA in multiple ways, including:
a) Engaging in conduct the natural consequence of which is to harass, oppress, or abuse Consumer (§ 1692d));
b) Falsely representing or implying that nonpayment of Consumer's debt would result in the seizure, garnishment, attachment, or sale of his property or wages, where such action is not lawful or Defendant did not intend to take such action (§ 1692e(4);
c) Threatening to take an action against Consumer that cannot be legally taken or that was not actually intended to be taken (§1692e(5);
d) Threatening Consumer that nonpayment of Consumers debt may result in the arrest of Consumer or the seizure, garnishment, attachment or sale of any property or the garnishment or attachment of wages of Consumer where such action was not in fact contemplated by the debt collector and permitted by the law;
e) Threatening to take an action against Consumer that is prohibited by law;
f) Falsely representing that a legal proceeding has been, is about to be, or will be instituted unless payment of a consumer debt is made; and
g) Failing to provide Consumer with the notices required by 15 USC§ 1692g, either in the initial communication with Consumer, or in writing within 5 days thereof (§ 1692g(a).
As a result of the violations, Consumer alleged that he suffered injury and that PFS is liable to him for his actual damages, statutory damages, and costs and attorney's fees.
