Carrington Mortgage Services, LLC is a mortgage company headquartered in Anaheim, CA with lending and mortgage servicing operations that services over $10 billion in mortgages around the country. These extensive lending and serving operations have caused Carrington to experience many legal problems under the Fair Debt Collection Practices Act.
In a recent case filed in Orange County, Florida, Plaintiff alleges that he took out a mortgage with Bank of America in 2009 in order to purchase a home in Altamonte Springs, Florida. He fell on hard times and in April of 2013, he filed for bankruptcy. By law, he did not owe the money anymore – the debt was discharged.
Ultimately, the account was assigned to Carrington Mortgage Services who, in 2016, attempted to collect the debt that was discharged in bankruptcy. Plaintiff wrote to Carrington and told them about the bankruptcy. They then sent him a nice letter apologizing and saying that they would not bother him anymore. Within weeks of this letter, the sent him two more collection letters.
Plaintiff sued Carrington under the Fair Debt Collection Practices Act and the Florida Consumer Collection Practices Act as both laws prohibit debt collectors from attempting to collect a debt from a consumer that they do not owe.
